What is an uncontested divorce?

An uncontested divorce occurs when both spouses mutually agree on all aspects related to their divorce, including property division, child custody, and alimony. This agreement is typically formalized in a written Separation Agreement.  Unlike a contested divorce an uncontested divorce can offer several advantages, including, a speedy divorce, reduced stress, and lower legal costs.

Do I qualify for an uncontested divorce?

To qualify for an uncontested divorce, you and your spouse must live separate and apart for 1 year.

If you don’t have any minor children and you and your spouse have signed a separation agreement, you may divorce after 6 months of separation.

What are separation agreements?

Separation agreements, also commonly referred to as Settlement Agreements, are legally binding documents that divorcing spouses voluntarily sign. These agreements serve to define their responsibilities and entitlements, including matters like child support, financial obligations, and property ownership, both during and after the divorce process.
