STEP 2:

Service of Process

In order to move forward in the divorce process, your spouse must be given notice of the divorce proceedings. This is done by serving your spouse with a copy of the complaint for divorce. After your spouse is served, they are given a set amount of time to respond to the complaint, depending on how they are served.

If your spouse is willing to cooperate and signs and notarizes the Acceptance/Waiver of Service of Process form and Final Decree, you won't have to wait for 21 days. Instead, the divorce proceedings may continue immediately. If, however, your spouse is unwilling to cooperate and/or refuses to sign and notarize the Acceptance/Waiver of Service of Process form and Final Decree, you must wait at least 21 days before continuing with the divorce.
